Prosecutors keep losing cases filed against local cops. This retired chief thinks the prosecutions were politically motivated.

Retired Riverside Police Chief Tom Weitzel has raised concerns over the recent trend of Cook County State’s Attorney’s Office dropping criminal charges against police officers accused of wrongdoing. This comes after prosecutors dismissed charges against Oak Lawn Police Officer Patrick O’Donnell, who was accused of using excessive force during the arrest of a 17-year-old boy.

According to reports, the decision to prosecute O’Donnell was deemed “outrageous and unprecedented” by Weitzel, who questioned the rush to secure a grand jury indictment without a comprehensive review by the Illinois State Police. He suggested that former State’s Attorney Kim Foxx may have had a predetermined conclusion before the investigation was complete.

Weitzel highlighted several cases where charges against police officers were dropped or dismissed in court, including the high-profile case of CPD Officer Bruce Dyker, charged with aggravated battery and official misconduct after an altercation with a Black woman at North Avenue Beach. The entire case was eventually dropped by the state’s attorney’s office.

Weitzel expressed concerns that weak cases were pursued by prosecutors to gain political notoriety, rather than focusing on the evidence. He criticized the approach of charging officers with crimes without sufficient justification, suggesting that it was a tactic to align with the “defund the police” movement.

Several other cases were mentioned where charges against police officers were dropped or resulted in acquittals, raising questions about the preparation and handling of these cases by the state’s attorney’s office. Weitzel called for a rebuilding of trust between prosecutors and police agencies in Cook County, recommending the appointment of a police agency liaison to facilitate communication and collaboration.

The new Cook County State’s Attorney Eileen O’Neill Burke has been urged to take steps to improve relations with law enforcement and focus on reducing violence by gaining public trust in the enforcement of public safety initiatives. Weitzel commended Burke for appointing experienced prosecutors to key positions and emphasizing initiatives aimed at enhancing public safety.
