Nomcebo Zikode, the renowned singer behind the global hit “Jerusalema,” recently faced a setback in her legal battle against Open Mic Productions. The Pretoria High Court delivered a judgment on 9 May 2025, dismissing Zikode’s application to declare parts of a 2022 settlement agreement unenforceable. As a result, she is required to deliver two more albums to Open Mic before she can exit her contract.
In a joint statement with her company, Emazulwini Productions, Zikode expressed disappointment with the court’s decision. She shared her frustration on Instagram, noting that she has yet to receive any payment for her work. Despite the setback, Zikode remains determined to fight for justice and the rights of artists in South Africa.
The legal dispute between Zikode and Open Mic Productions stems from issues surrounding royalties and rights related to her songs “Jerusalema” and “Bayethe.” While a settlement was reached in 2022, establishing a 50/50 joint venture for future releases, Zikode later accused the label of failing to fulfill their obligations.
In her court application, Zikode sought transparency from Open Mic regarding income generated from various sources, including synchronisation licences, bookings, and brand deals. However, the court ruled that she could not seek relief beyond the terms of the 2022 agreement, leading to the dismissal of her claims.
Despite the setback, Zikode and her record label are not backing down. They view the judgment as a reflection of broader issues within the music industry, where artists often face exploitation and unfair treatment. The statement released by Zikode’s team emphasizes the importance of acknowledging, compensating, and respecting artists for their creative work.
At this time, Zikode’s legal team is considering an appeal to challenge the court’s decision. The ongoing battle highlights the challenges faced by artists in navigating complex contractual agreements and ensuring fair compensation for their artistry.
As Zikode continues to fight for justice, her story serves as a reminder of the importance of protecting artists’ rights and advocating for fair treatment within the music industry. Despite the legal hurdles she faces, Zikode remains committed to standing up for herself and others who find themselves in similar situations.
