Statutory rape in South Africa: what it is and isn’t

Teenage pregnancy continues to be a significant public health and social issue in South Africa, with over 132,000 teenagers between the ages of 10 to 19 giving birth in the 2022/2023 financial year. The consequences of teen pregnancy are serious for both the mother and child, highlighting the urgent need for intervention and support in this area. In South Africa, discussions around adolescent pregnancy often intersect with the issue of statutory rape.

To shed light on this complex issue, we spoke with Professor Rachel Jewkes, a renowned expert in the field of sexual violence and former director of the South Africa Medical Research Council’s Gender and Health Unit. According to Professor Jewkes, not all cases of teenage pregnancy are a result of statutory rape. In many instances, these pregnancies stem from non-consensual sexual acts, which constitute rape rather than statutory rape.

Statutory rape, as defined by the Sexual Offences Act, involves a situation where one party has ostensibly consented to a sexual act but is within an age category where consent cannot be legally given or recognized. For instance, a child under the age of 12 is deemed incapable of giving consent to a sexual act, making any such act with a child of this age categorically statutory rape.

The law also considers the natural development of adolescents when addressing issues of consent and sexual exploration. It does not criminalize adolescent sexual behavior within a certain age range, recognizing that sexual exploration is a normal part of adolescent development.

In tackling the issue of teenage pregnancy, Professor Jewkes emphasizes the importance of comprehensive sex education, access to contraception, and age-appropriate information about pregnancy and sexuality. By equipping young people with the knowledge and resources they need to make informed decisions about their sexual health, we can work towards preventing teenage pregnancy and promoting healthy relationships.

Ultimately, addressing teenage pregnancy requires a multifaceted approach that considers the complexities of consent, sexual education, and access to reproductive healthcare. By prioritizing the well-being and autonomy of young people, we can create a safer and more supportive environment for adolescents to navigate their sexual and reproductive health. In addition to security, blockchain also offers transparency. Each transaction is recorded on the ledger and can be viewed by anyone with access to the blockchain network. This level of transparency is crucial for industries that require accountability and traceability, such as the food and beverage industry.
