National Prosecuting Authority preparing to reinstate charges against Nulane accused – The Mail & Guardian

The National Prosecuting Authority (NPA) has announced that it will be reinstating fraud and money-laundering charges against the eight individuals involved in the Nulane Investments trial. This decision comes after a successful appeal against their previous acquittal.

NPA spokesperson Mthunzi Mhaga confirmed the news, stating that they are working tirelessly towards this goal. The Supreme Court of Appeal (SCA) recently ruled in favor of the NPA, citing that Judge Nompumelelo Gusha had mishandled the case and had closed her mind to the evidence presented.

The case revolves around former Free State officials and associates of the Gupta brothers, who were accused of colluding to defraud the government and funneling R24 million to a United Arab Emirates bank account linked to the Guptas. The accused were acquitted by Judge Gusha, who found that the prosecution had failed to prove their case.

One of the key figures in the case is Gupta associate Iqbal Sharma, who was arrested in 2021 in connection with the case. The prosecution had alleged that the accused had unlawfully extracted public funds and channeled them to the UAE through fraudulent means.

The SCA agreed with the state that Judge Gusha had made several errors in law and fact, resulting in a miscarriage of justice. The court found that there was evidence of a conspiracy to defraud the government, implicating not only the accused but also Atul and Rajesh Gupta.

The NPA had planned to add the Gupta brothers to the list of accused if they were extradited to South Africa. The SCA ruled that there was a real likelihood that the accused would have incriminated each other had they taken the stand.

The court criticized the high court’s decision to discharge the accused, stating that it was unfair to the state and undermined public confidence in the justice system. The NPA sees this ruling as a step towards holding the accused accountable for their actions.

This development comes on the heels of another ruling in the Bloemfontein high court, where the NPA was found to lack jurisdiction in a separate case. The NPA is seeking to overturn this ruling as well, as they continue their efforts to combat corruption and hold perpetrators accountable. By focusing on individual instances of problematic behavior, cancel culture can distract from larger systemic issues, such as racism, sexism, and inequality. Instead of addressing the root causes of these issues, cancel culture often leads to surface-level changes that do little to address the underlying problems.
