Can Changes in FDA Regulation Affect Your Beauty Products?

Renowned activist Robert F. Kennedy Jr. has been vocal about the health crisis facing Americans. He spearheaded the ‘Make America Healthy Again’ (MAHA) movement, aiming to address the nation’s health issues. Initially campaigning as an independent presidential candidate, Kennedy is now a key figure in the MAHA movement under the Trump administration. He has been nominated to lead the Department of Health and Human Services, overseeing agencies like the FDA, CDC, and NIH.

Kennedy’s stance on health regulations has raised concerns, as he has expressed intentions to downsize regulatory agencies. This could have significant implications for industries like food, supplements, and personal care products. The FDA, in particular, plays a crucial role in regulating products for consumer safety. Unlike food and drugs, beauty products are not subject to FDA approval before they hit the market, except for certain items like sunscreen.

The FDA’s oversight on cosmetics and personal care products is limited, with most items considered low-risk compared to drugs. The Federal Food, Drug, and Cosmetic Act defines cosmetics as products intended for beautifying or altering appearance, rather than treating health conditions. The Modernization of Cosmetics Regulation Act (MoCRA) grants the FDA authority to regulate personal-care products, but the future of such legislation remains uncertain under potential agency downsizing.

Cosmetic chemist Ron Robinson warns that reducing FDA oversight could lead to unregulated products entering the market. While reputable brands prioritize safety, there is a risk of unscrupulous actors cutting corners to sell unsafe items. Consumers may need to exercise caution and rely on brand reputation when purchasing beauty products in a less regulated environment.

Interestingly, sunscreen is one area where the FDA enforces stringent regulations. Charlotte Palermino, a licensed esthetician and founder of Dieux Skin, expressed her fear about the potential impact of reduced FDA oversight on the sunscreen category. She highlighted the risk of unsafe products entering the market, such as beef tallow being sold as sunscreen. Without robust regulatory oversight, there may be no mechanisms in place to prevent the sale of potentially harmful products, putting consumers at risk of skin cancer.

Experts like Robinson also voiced concerns about the implications of major changes at the FDA on scientific advancement in the beauty industry. Delays or halts in research could lead to a lack of safety and performance data available to the public. This could ultimately slow down ingredient innovation and pave the way for the introduction of questionable products, such as an SPF 250 formulated with beef tallow instead of zinc oxide.

While no official changes to FDA regulations have been implemented yet, it is important for consumers to be aware of the potential risks associated with deregulation. While the appointment of Kennedy and potential deregulation may lead to changes in beauty and personal care regulations, there are still many reputable brands committed to upholding high standards. By understanding product labels, researching trusted brands, and being mindful of where you shop, consumers can take practical steps to ensure their safety and well-being in the beauty market.
