Appeals Court Restores Trump’s Control of California National Guard

The Ninth U.S. Circuit Court of Appeals has issued a temporary stay in a ruling that restores President Donald Trump’s control of the California National Guard, overturning a previous order from U.S. District Judge Charles Breyer to return control to Gov. Gavin Newsom.

The dispute arose after Trump federalized the guard amid protests and riots in Los Angeles. Breyer had deemed Trump’s actions illegal, citing violations of statutory authority and the Tenth Amendment to the United States Constitution.

The appeals court’s stay will remain in effect until at least Tuesday, allowing the administration to maintain control of the state’s guardsmen for an additional four days. The legal rationale behind the ruling was not disclosed by the judges.

During a hearing, arguments were made regarding whether Trump had the authority to federalize the National Guard under federal law. Justice Department attorney Brett Shumate contended that Trump followed the law, while California’s attorney, Nicholas Green, argued against an overly expansive view of federal power.

The crux of the issue was Section 12406 of the law, which requires an order to be issued through governors when the president takes control of the National Guard. Trump’s order was sent directly to the adjutant general, bypassing Newsom.

Breyer’s opinion highlighted the failure to comply with the law by not involving the governor in the process. He emphasized the potential threat to the constitutional balance of power between federal and state governments and the violation of the Posse Comitatus Act’s prohibition on using the military for domestic law enforcement.

The ruling did not directly affect Marines who were expected to replace some National Guard members in the state. The decision raised questions about how the president should coordinate with state governors to satisfy federal law.
