However, despite the positive response towards plain packaging, the tobacco industry has been vehemently opposing this measure as part of the Tobacco Bill. The Bill, which has been in development since 2018, aims to regulate tobacco products and packaging in South Africa.

Big Tobacco argues that plain packaging could lead to an increase in illicit trade, as it would be easier for counterfeit cigarettes to enter the market. They claim that without distinct branding, consumers may not be able to differentiate between legal and counterfeit products. However, recent studies have shown that the illicit market primarily involves legitimate local manufacturers who evade taxes while still producing branded cigarettes.

Furthermore, the tobacco industry contends that the Bill fails to distinguish between traditional cigarettes and newer, less harmful nicotine products. They argue that grouping these products together may hinder efforts to reduce smoking rates. However, experts suggest that the industry’s concerns are premature, as detailed regulations outlining specific warnings for each product category have yet to be finalized.

During a recent parliamentary hearing, the tobacco industry continued to oppose the Bill, advocating for a more gradual implementation of packaging regulations across all nicotine products. Ultimately, the fate of the Bill rests in the hands of the National Assembly, which will decide whether to pass, amend, or reject it before it moves on to the National Council of Provinces and the president for final approval.
