Rape in South Africa is a pervasive issue that has been described as a societal and public health crisis. Despite an estimated 40,000 cases being reported every year over the last decade, research shows that most survivors do not report their rape to the police. This lack of reporting has serious implications, as survivors often do not receive the much-needed post-rape medical care or mental health support that they require.

In response to this crisis, several organizations in South Africa are working tirelessly to support survivors and help them navigate the difficult process of seeking justice. One such organization is the Networking HIV and AIDS Community of Southern Africa (NACOSA).

Sophie Hobbs, the Head of Strategic Communications at NACOSA, emphasizes the importance of prioritizing healthcare for survivors of rape. She dispels the misconception that survivors need to report the case to the police before seeking medical services. Survivors can receive medical care without laying a charge, and it is crucial to receive this care within 72 hours of the assault. This medical care includes testing for HIV, post-exposure prophylaxis (PEP) for HIV-negative survivors, emergency contraception, and screening for sexually transmitted infections.

Hobbs explains that a forensic examination is often conducted to gather evidence for potential prosecution of the perpetrator. While survivors have the right to refuse this examination, it is encouraged as the evidence can be used if they decide to pursue legal action in the future.

Many survivors do not immediately report their assault, with around 70% of perpetrators being known to the victim. This familiarity with the perpetrator often leads to reluctance to report due to family pressure and stigma. In cases where the 72-hour window for medical care is missed, survivors may not be able to access certain medications like PEP or emergency contraception, but they still have the right to all services in the process of seeking justice.

Navigating the process of seeking justice can be overwhelming, which is why Hobbs recommends having a trusted friend or family member accompany survivors to advocate for their rights. She clarifies that survivors can report a rape at any police station, not just in the area where the assault occurred.

Survivors have the right to request specific actions during the legal process, such as having the perpetrator tested for HIV, applying for a protection order, and being assisted by a female investigating officer. The laws in South Africa are comprehensive and progressive, but there is a need for better enforcement and understanding of these laws to ensure that survivors know their rights and have access to the necessary services.
