President-elect Donald Trump’s legal team is making a bold move in his hush money case, seeking to halt the sentencing hearing while an appeal is underway. Despite the judge’s previous indication that Trump would not face prison time for his 34-count felony conviction, his lawyers, Todd Blanche and Emil Bove, are determined to challenge two rulings that dismissed the case on immunity grounds.

Scheduled for sentencing on Friday, Trump faces the prospect of being officially labeled a convicted felon. Blanche and Bove plan to file their appeal on Monday, arguing that Trump’s constitutional protections and the Supreme Court’s immunity ruling should prevent any sentencing while the appeal is ongoing. They claim that the case is fundamentally flawed and based on false claims from a discredited attorney.

In a previous ruling, Judge Juan Merchan rejected Trump’s arguments for presidential immunity, emphasizing that the evidence presented related to unofficial conduct and therefore did not impede the executive branch’s authority. The jury’s guilty verdict in May stemmed from Trump’s alleged cover-up of a payment to adult film actor Stormy Daniels, orchestrated by his former lawyer Michael Cohen.

Despite maintaining his innocence, Trump faces the possibility of an unconditional discharge sentence, which typically entails no fines or jail time. His legal team has requested an emergency appellate review if the judge does not respond promptly, aiming to vacate the sentencing hearing and resolve the case’s remaining deadlines.

This latest development comes after multiple delays in the sentencing process, initially scheduled for July but postponed to accommodate the Supreme Court’s review and Trump’s campaign demands. As the legal battle continues, Trump’s spokesperson has yet to provide a comment on the matter.
