Trump Admin Says Abrego Garcia Will Face Trial on Criminal Charges Before He Can Be Deported

The Trump administration has made it clear that Kilmar Abrego Garcia will face trial on illegal immigrant smuggling charges before any attempts are made to deport him for a second time. Abrego Garcia, a Salvadoran national, was deported to his home country earlier this year but has since been returned to the United States to face criminal charges.

It has been alleged by the Trump administration that Abrego Garcia is a member of the notorious MS-13 gang. He has been indicted on two felony charges of smuggling illegal immigrants into the United States and conspiring with others to do so. The indictment states that between 2016 and 2025, Abrego Garcia and other individuals conspired to bring undocumented aliens into the United States from various countries, ultimately passing through Mexico before crossing into Texas.

Abrego Garcia’s lawyers have denied these claims, stating that the case against him is baseless and is solely based on the statements of individuals who are facing prosecution or are in federal prison. They believe that there is no substantial evidence to prove that Abrego Garcia is the leader of an international MS-13 smuggling conspiracy.

The Supreme Court ruled in April that the Trump administration must facilitate Abrego Garcia’s return to the United States and ensure that his case is handled as it would have been had he not been improperly deported to El Salvador. The administration has admitted to an administrative error in his deportation.

Abrego Garcia is set to be released without bail, but he will likely be taken into immigration custody immediately. The judge has imposed conditions on his release, including seeking employment and limiting his travel to certain areas.
