Former election workers Ruby Freeman and Shaye Moss are once again seeking justice as they accuse Rudy Giuliani of defaming them. In a court hearing in Washington, D.C., Freeman and Moss claimed that Giuliani had violated a previous injunction placed on him in December 2023 after a federal court found him liable for defaming the two women during the 2020 election.

Giuliani was ordered to pay Freeman and Moss $148 million and was prohibited from making any further false statements about them. However, according to a motion for civil contempt filed by their attorneys, Giuliani blatantly disregarded the injunction and continued to make defamatory remarks about the women.

The attorneys representing Freeman and Moss are now requesting the court to impose fines on Giuliani for each violation in the future. They are also seeking a hearing to determine the amount of the fines that should be imposed. Civil contempt orders typically include sanctions such as fines, jail time, or both, to penalize individuals for disobedience.

In 2020, Giuliani falsely accused Freeman and Moss of engaging in voter fraud while they were working as poll workers at State Farm Arena in Georgia. He spread these baseless claims on social media, television, and podcasts, even peddling them to then-President Donald Trump, who used the allegations to publicly attack the women.

Giuliani filed for bankruptcy after being ordered to pay $148 million to Freeman and Moss. Despite this financial setback, Giuliani resumed his defamatory rhetoric about the women just six months later. In recent broadcasts of his podcast, “America’s Mayor Live,” Giuliani repeated false claims that Freeman and Moss were involved in fraudulent activities during the election.

During one episode of his podcast, Giuliani falsely alleged that Freeman and Moss passed a USB drive containing votes for Joe Biden to each other, insinuating that they intended to manipulate the election results. However, there was no evidence to support these claims, as it was later revealed that the object exchanged between the women was a ginger mint, not a USB drive.

Despite the debunking of his claims and the court order prohibiting him from defaming Freeman and Moss, Giuliani continued to propagate lies about the women. In a transcript provided by their attorneys, Giuliani acknowledged that his remarks could lead to further legal action against him but insisted that he was telling the truth.

In a subsequent episode of his podcast, Giuliani doubled down on his false allegations, claiming to have video evidence of Freeman and Moss manipulating vote counts. However, multiple law enforcement agencies reviewed the surveillance footage from State Farm Arena and found no evidence of fraud.

A final report issued by the Georgia secretary of state on Mar. 7, 2023, confirmed that no fraud had occurred during the election at State Farm Arena. Despite the lack of evidence supporting his claims, Giuliani persisted in spreading misinformation about Freeman and Moss.

When asked by a reporter if he regretted defaming the women, Giuliani remained unrepentant. His continued defamation of Freeman and Moss has led their attorneys to seek further legal action against him, in the form of civil contempt charges. Giuliani’s repeated violations of the court order and his perpetuation of false claims about Freeman and Moss highlight the importance of holding individuals accountable for spreading misinformation and defaming others. Giuliani is scheduled to go on trial in New York on January 16 to address the enforcement of $148 million in damages, but he has requested a delay to attend Trump’s inauguration on January 20 and other pre-inauguration events. In response to this request, Moss and Freeman’s lawyers have asked the judge overseeing the case to shorten the deadline for Giuliani to produce discovery items from 30 days to 2 weeks.

Giuliani’s legal team has not responded to requests for comment on the matter. However, a lawyer for the women stated that Giuliani’s compliance with discovery requests is crucial for preparing for the trial, as he has shown a lack of willingness to meet deadlines in the past.

In a statement to JS, Giuliani’s spokesperson Ted Goodman called the motion for civil contempt a “dishonest and duplicitous attack” aimed at silencing Giuliani’s right to free speech. Giuliani’s attorney, Cammarata, responded to the demand for an expedited briefing schedule, accusing the women of improperly filing the case in New York instead of Florida, where Giuliani also resides.
