Musa Khawula’s Legal Proceedings Continue with Media Coverage Despite Opposition
The controversial self-proclaimed ‘Pope of pop culture,’ Musa Khawula, will remain in custody as his lawyer requested a postponement during his court appearance on Tuesday. Despite his lawyer’s unpreparedness, the Magistrate approved the media’s request to film the court proceedings.
Khawula’s lawyer, Ofentse Nkgwang, requested the postponement, leading to his next court appearance scheduled for 29 January 2025. The National Prosecuting Authority (NPA) spokesperson, Phindi Mjonondwana, confirmed that Khawula has two other pending cases, one for murder in the Western Cape and another for reckless and negligent driving in Fochville, Gauteng.
The state opposed bail for Khawula due to the pending cases against him, but the decision ultimately lies with the court. Despite the legal troubles he faces, Khawula appeared relaxed as he entered the courtroom and even waved at journalists.
The arrest of Khawula in Newcastle stemmed from derogatory statements he posted about entrepreneur Zee Nxumalo on his social media platform, which has a significant following. The state argued against bail, citing the accused’s pending murder case and an outstanding warrant of arrest for reckless and negligent driving.
Sergeant Keshi Mabunda’s investigation revealed the need to verify the accused’s profile and physical address for a comprehensive bail application. The media applied to film the court proceedings, which Khawula’s lawyer initially opposed. However, the Magistrate granted the media’s request to film the proceedings.
Khawula is facing charges of crimen injuria, contravention of Section 19 of the Cyber Crimes Act 19 of 2020, and hate speech. While photographs are prohibited inside the court, media access to court proceedings follows national guidelines set by the Magistrates’ Commission.
According to the guidelines, media representatives must lodge an application in court at least 24 hours before the proceedings commence. The presiding officer may condone the failure to adhere to the 24-hour notice period.
Despite the opposition to media coverage, Khawula’s legal proceedings continue with heightened public scrutiny. The unfolding events surrounding the ‘Pope of pop culture’ will undoubtedly attract widespread attention as the case progresses.
