Head of human smuggling plot gets 10 years after family of 4 froze to death

The tragic incident of a family of four from India freezing to death while attempting to enter the U.S. along the Canadian border in a blizzard has finally seen some form of justice, as the convicted ringleader of the human smuggling plot was sentenced to 10 years in prison in Minnesota. Harshkumar Ramanlal Patel, the mastermind behind the operation, had federal prosecutors recommending nearly 20 years for his crimes, while the driver, Steve Anthony Shand, received a 6 1/2 year sentence.

The judge presiding over the case, U.S. District Judge John Tunheim, acknowledged the avoidable deaths of the family and emphasized the impact of Patel’s greed on the migrants seeking a better life in America. Patel’s attorney claimed his innocence and argued for a lesser sentence, while the acting U.S. attorney for Minnesota highlighted the defendant’s exploitation of the migrants’ hopes.

The smuggling operation orchestrated by Patel and Shand involved bringing dozens of people from India to Canada on student visas and then smuggling them across the U.S. border. Tragically, the victims, including Jagdish Patel, his wife, and their two children, froze to death in the harsh blizzard conditions. The family’s desperate attempt to find Shand in the snow-covered wilderness ultimately led to their demise.

Prosecutors described the heartbreaking scene of the father trying to shield his son from the freezing wind, while the mother slumped against a fence in a futile search for salvation. Only a few members of their group survived, with one woman suffering severe frostbite and hypothermia. The survivors bore witness to the callous indifference of the smugglers to the perilous weather conditions.

Despite maintaining his innocence, Patel was sentenced to 10 years in prison, with the likelihood of deportation to India upon completion of his term. Shand, on the other hand, received a 6 1/2 year sentence and will serve his time at a federal prison camp in Florida. The judge’s decision to impose these sentences in the federal courthouse in Fergus Falls signifies a form of closure for the victims’ families and the community.

The tragic incident serves as a stark reminder of the dangers associated with human smuggling and the lengths to which individuals will go in search of a better life. As the region grapples with ongoing issues of human smuggling along the northern border, law enforcement officials are working tirelessly to prevent similar tragedies from occurring in the future. The sentencing of Patel and Shand sends a strong message about the consequences of exploiting vulnerable individuals for financial gain and underscores the value of human life above all else.
