The father of Elijah McClain, Lawayne Mosley, has been sentenced to 10 days in jail or home detention and received a 12-month deferred sentence for assaulting a Colorado State Patrol trooper during a drunken-driving arrest. This decision was made by the Arapahoe County District Attorney’s Office.
Mosley, 54, appeared in Arapahoe County District Court on Monday to face the consequences of his actions in the January altercation. He pleaded guilty to felony second-degree assault on a police officer and DUI back in August, which ultimately led to his sentencing.
As part of his sentence, Mosley will serve 10 days in jail with credit for one day already served. Alternatively, he can opt for home detention. In addition, he will be on probation for 12 months for the DUI charge.
The incident occurred on January 20 when Mosley was pulled over by a trooper on Interstate 70 after another driver reported his erratic driving behavior. Mosley failed to comply with the trooper’s instructions to exit the vehicle, and when the trooper attempted to assist him, Mosley assaulted the officer.
During the arrest, Mosley identified himself as the father of Elijah McClain, whose tragic death in 2019 sparked nationwide outrage. McClain, a 23-year-old, was wrongfully detained by Aurora police officers and subjected to a fatal neck hold and a dose of ketamine by paramedics.
Following McClain’s death, there were significant developments, including the convictions of three first responders, reforms within the Aurora Police Department, statewide changes regarding the use of ketamine in police encounters, and a $15 million settlement in a civil rights lawsuit filed by McClain’s parents against the city of Aurora.
