Two days left for Gayton McKenzie to respond to K-word allegations – The Mail & Guardian

The South African Human Rights Commission (SAHRC) has initiated a formal investigation into Sport, Arts, and Culture Minister Gayton McKenzie following the resurfacing of old social media posts in which he allegedly used racial slurs, including the K-word.

The commission received complaints from political parties and the public after the posts, dating from 2011 to 2017, circulated earlier this month. The content sparked public outrage and calls for McKenzie’s removal from the cabinet.

In a statement, the SAHRC stated that the posts constituted a prima facie violation of the Promotion of Equality and Prevention of Unfair Discrimination Act. They deemed McKenzie’s behavior inconsistent with the ethical standards expected of a cabinet minister and member of parliament.

Following their assessment of the posts, the commission concluded that Minister McKenzie’s remarks were in breach of the Equality Act. As a result, they issued him with an allegation letter outlining remedial actions and requiring a response by 20 August. Failure to comply could lead to the matter being taken to the Equality Court.

The proposed measures include deleting the offensive posts, issuing a public apology in consultation with the commission, undergoing sensitivity training, and making a donation to a charity.

SAHRC spokesperson Wisani Baloyi emphasized that the right to freedom of expression is not absolute and cautioned against using hate speech under the guise of free speech protections. They reminded the public to uphold constitutional principles of human dignity, equality, and non-discrimination.

In response to the allegations, McKenzie denied using the K-word and refused to apologize, claiming he was not guilty of any crime. He dismissed the controversy as politically motivated, accusing the Economic Freedom Fighters (EFF) of orchestrating a smear campaign against him.

The resurfacing of the posts and the SAHRC’s investigation have elicited strong reactions from various political parties. ActionSA welcomed the inquiry, asserting that no cabinet minister should escape accountability for using racial slurs. The EFF called for McKenzie’s immediate dismissal, citing the need for integrity in leadership roles responsible for national identity and cultural diversity.

The EFF also criticized McKenzie for his inconsistency and hypocrisy, pointing out his recent condemnation of offensive remarks against colored people while being embroiled in a racism scandal himself. They argued that individuals who demean others based on race should not hold leadership positions, especially in spaces requiring engagement with diverse communities.
